Hughes, I argue that a realistic model of political deliberation and participation suggests that, in the absence of major institutional changes, increased opportunities to participate in politics will compound the rhetorical pathologies that plague public political deliberation under current institutional constraints. If changes in the institutional structures that prevent deliberative forums from generating sincere, open-minded, and well-informed political deliberation are unfeasible, governments should focus on protecting free speech and freedom of association, as something different from expanding deliberative forums.;Type of Presentation: Professional Organization;

Law and Liberty.More infoIn this review of Cass Sunstein's book, ON FREEDOM (2019), I discuss Sunstein's development of his well-known "libertarian paternalism," which attempts to combine a libertarian commitment to freedom of choice with a form of paternalism that tinkers with the default consequences of doing nothing, instead of coercing individuals into prudent behavior. I argue that Sunstein's argument would be more persuasive if it paid attention to the cumulative effects of the freedom- and welfare-enhancing interventions that he advocates. Public choice theory suggests that such effects are less attractive than suggested by Sunstein's discussion.
